Legal Question in Family Law in Texas

My rights

My husband wants a divorce. He said I could have full custody of our daughter and I could move back to South Carolina where my family lives . If I do this can I get in trouble /give him reason to take her away from me ? He said it was ok ,and even set down and told me how much he would be willing to pay in child support . This just all seems like a scam to me . He told me he was getting back with his old girlfriend that is why he wants the divorce . I think it is a trap he and girlfriend has set up for me . Your advice please.

Re: My rights

I seriously consider filing for divorce in Texas and getting a temporary order that allows exactly what your hubby is telling you. At the very least I get something in writing. If you have the budget and he wont fight this, I file for divorce here in Texas. Get temp orders.. Go to SC and wait till you have jurisdiction there. Then dismiss the Texas divorce and refile in SC. That way you have a SC decree and wont have to worry about modification and enforcement issues since hubby lives in Texas.

Good luck
