Legal Question in Family Law in Texas

My sister's ex-husband had primary custody of their two kids. She did not have a car when they divorced and she could not provide for them. He got arrested and he sent the children to their mom's (my sister). She got them in school and got a car and made a way for them to be with her. He is now out on bond and wants the kids back until his trial. Does he have any legal right to have the kids? He was arrested on a blue statewide warrant for violating probation and tested positive for drugs.

The judge must do what is in the best interest of the children.
