Legal Question in Family Law in Texas

temporary guardianship

Our family is relocating from Texas to California. Our daughter will be a senior in high school next year (2009/2010). She is going to stay with friends in Texas, to finish her senior year. Do we have to transfer legal guardianship to our friends in order for her to live with them and continue attending her high school?

I would really think about what you are going to do since, you may be subject to a SAPCR or lawsuit for custody over your child.

If your daughter is going to be a senior I wouldn't worry too much about the conservatorship issue. Assuming you are still supporting your child, I doubt the other family would find it worthwhile or desirable to drag everyone into court when the child will be 18 soon anyway.

You should check and see what the school district will require for her to stay in school and then make sure the other parents have your written permission to consent to medical treatment. There may be other issues that you want to address depending on the circumstances.
