1. Did you engage in any pre-trial discovery (before the final hearing)?

2. Did you and the ex-spouse exchange inventories during the pendency of the divorce?

2. What (if anything) does your decree say about undisclosed assets?

Depending on the circumstances, there is no time limit - he has in his possession property that you own half of, and there's no time limit on owning something.

Based on what you have written, there are a variety of questions which must be answered first prior to their being a "timeline" to sue an ex-spouse. Some of the questions would be things like: (i) in the final decree is there any mention of what happens when assets are not disclosed? and (ii) did the parties do any discovery (e.g., exchange of documents, evidence, inventories, etc.)? You should consider consulting with a law firm to ensure that your rights and interests are protected as available under the law.

The above response given is not intended to create, nor does it create an on-going duty to respond to questions. Additionally, the response does not form an attorney-client relationship, nor is it intended to be anything other than an educated opinion. It should not be relied upon as legal advice. The response given is based upon the limited facts provided by the person asking the question. To the extent additional or different facts exist, the response might possibly change.
