Legal Question in Medical Leave in Texas

Family Medical Leave Act

I was employed full time at a medical office. In March I went Part-Time on the advice of my doctor due to pregnancy and associated backpains, etc.. I was granted the part-time status under the Family Medical Leave Act, however, today I was demoted to File Clerk (which is fine as I thought I would be getting the same pay rate that I started out with when hired), but now I have a large paycut, almost 1/3 of my previos salary. It was my understanding that a position had to be found with the same compensation as my previous position. Is this legal what my company is doing?

I look forward to your response.

Re: Family Medical Leave Act

It appears that you have been discriminated against, although there are some exceptions to the requirement that you be returned to your previous position or a similar one. It is unclear from your question whether this was appropriately done or not by your office, and you might wish to contact a lawyer who is experienced in this area and provide more information.
