Legal Question in Medical Leave in Texas

Threaten to be fired because Im pregnant

I've work for Bank Of America since December 2005. I recently got pregnant and Ive had my doctor put me on bed rest twice since December for a week at a time because I almost miscarried my baby. My managers have writen me up for ''being out of work to often for the same thing''. They said they that if I contunue to miss work that it could lead to termination. I told them I almost miscarried my child it wasnt something that I could help! I brought a doctors note and I still have the notes I gave them copies. Its a medical condition I can not help and all they had to say to that was just because my doctor writes a note does not mean they can not do thier job. (meaning by writing me up)

I did sign something when I fist started over a year ago that I understand that frequently being out from work can lead to write ups but it was to keep people from skiping work. I was out because I almost lost my baby and I was bleeding to much to be there. They knew this and I had my doctors notes but they dont care. Is their anything I can do!? Please help me.

Thank you,

Tricia

Re: Threaten to be fired because Im pregnant

Assuming that you have worked more than 1250 hours in the past year for Bank of America, it sounds like a termination may violate the Family and Medical Leave Act. For more information about the FMLA, you can visit my website (www.memphisemploymentlawyer.net) or the Department of Labor's website (www.dol.gov). The Department of Labor has a lot of useful information, but is sometimes difficult to navigate unless you are used to it.

This is the sort of matter that if you are serious about protecting your job, you need to consult with an attorney. It sounds like you need information and someone to possibly intercede on your behalf with your employer.
