Legal Question in Civil Litigation in Texas

Hi,

I had a credit card with BOA. I paid them off in full last year and during a phone conversation had told them I was canceling the credit card. They said I couldn't cancel my card. They said there was some fraud claim or something which I told them all charges on the card were mine. There were never any charges on my statements which were not mine. I paid them in full, but they continue to send me updates about BOA. On April of this year, I called and told them to stop sending me any mailings that the card had been destroyed and I would never do any business with them again, and that their mailings constitute harassment. I just received another mailing from them this week. I owe them nothing, but they won't stop. What can be done and what type of lawyer would I need to pursue this further?

As I understand it, (a) Bank of America is showing you with a zero balance - not alleging that you owe them anything - and (b) they continue to send you their bulk-mail offers. And you want to stop receiving mail from them.

Sending out bulk-mail offers wouldn't be considered harassment. Your remedy is to put the mail directly into your trash can.

You might consider sending them PAPER MAIL (stop using the telephone) demanding that they take you off all mailing lists. Send the letter to each and every address you can find for them (they'll have several). Keep copies of the letters you send.
