Legal Question in Civil Litigation in Texas

Home Owner's Association

I had several items on my front porch which the homeowner's association told me was ''trash.'' I did not consider it trash and I had them there because I was planning to take them to another home but I did not have a truck to take them. I also had a bookcase and a door which I had covered with a tarp and they came one day and removed everything. They also went into my back yard and removed other items. Is it legal for them to enter my back yard without my permission.

Re: Home Owner's Association

Without some type of legal proceeding, I think it's called trespass.

Re: Home Owner's Association

Possibly. You'd have to read the restrictive covenants that govern your subdivision. Many times the HOA has the authority to go upon the property and cure the offensive problem at the homeowner's expense.
