Legal Question in Civil Litigation in Texas

A man was traveling at a great speed in his truck, veered off of the road and totaled my trailer, fence, truck, and a portion of my car. His insurace isonly paying what these items are worth, not replacement costs, leaving me to spend another $4,000.00 to get things as good as they were before the wreck. My question is: Can I sue this guy for the difference between what my invoices say I should get and what his insurance company paid. Did I fail to mention it was a hit and run but the police caught him.

Yes, you can sue him for damages regardless of what his insurance company pays. Be careful about the releases you sign when the insurance company actually gives you the check.
