Phone Conversations Recorded

Is itlegal in Texas for a party to record phone conversation for the purpose of a law suit and to use these recording in court without the party being advised that they are being recorded

No, it is legal as long as one person is party to the conversation. You cannot record two other people's conversation, but you can record one where you are a participant. This does not mean that a court will necessarily admit the recorded conversation into evidence, but it is legal to make the recording.

To adequately answer your question requires more information as to who it is making the recording and the general circumstances surrounding the recording. The civil statute pertaining to the interception of communications is located in the Texas Civil Practice & Remedies Code at Chapter 123.
