Legal Question in Civil Litigation in Texas

I pulled my credit report and noticed that there is a judgement on there. I called and found out that it is from a car accident that my boyfriend was involved in back in 2003. He did not have car insurance. He said that the lady left the scene of the accident and then came back. They said that they sent papers regarding the lawsuit to him and I as well. I never received any paper work regarding the lawsuit, and he does not remember it either. I called the law office that the lawsuit is out of and they said that it was for about $10,000, and now has earned about another $10000 in interest. It has cause my boyfriends license to be suspended, and is on both our credit reports since I was the owner of the car. I was not even present at the accident. I am trying the find out if there is anyway that I would be able to fight this and get it taken off my credit report or if after 7 years it will fall of my credit report. If it does come off my credit after 7 years do I have to dispute it to take it off? I am trying to buy a home and that is what is stopping me from being approved.

WRITE to the credit bureaus (a paper letter - lick a 44-cent stamp) and tell them the whole story. Demand that they remove the false information from your credit report.

And then go to the court where the lawsuit was filed and look at the court's file (you might call first and tell them you're coming). Look at the RETURN OF SERVICE that shows that you were served with the lawsuit. You may have the right to file an equitable bill of review even though the time limits for appeal have passed (you'll need a lawyer for this).
