Legal Question in Civil Litigation in Texas

settlement estate

My commmon law husband is recently deceased. We have one child,When he was 9 He was in an accident(a pizza hut delivery driver struck him with his car while my husband was riding his bike) and His mother recieved a settlement for permanent head injury. My Daughter is his only heir. Is she entitled to any of the Intial settlement, which I have been informed by his father Is in the millions. His mother never offered us help with getting a vehicle or with anything other than 250 dollars a month. my husband was again riding his bike(we couldnt afford a second car) and hit by a car and this time killed. The vehicles drivers insurance refuses so far to pay any lost wages on that accident due to his first head injury. I was just wondering what her legal rights are to the first settlement in georgia . I dont want any more or less than what she is entitled to. Thanx for your time--name removed--

Re: settlement estate

It depends on what the will says, if there is one. If there isn't one, it depends on who the legal heirs are and if there are creditors.

Re: settlement estate

This is too complicated to answer..call a lawyer experienced in personal injury claims, bring all documents you have when you visit the lawyer and he "may" be able to answer. If there was a settlement in Georgia? now a claim in Texas? we would visit with you, no fee for the visit, if you call first so we could understand the facts.
