Legal Question in Civil Litigation in Texas

In the State of Texas, what are the civil liabilities if a customer refuses to pay for a printing job at a printing/copy establishment (such as Kinkos, Officemax, Staples, etc)?

No contract was signed, the project was complete and ready for pick-up 24 hours AFTER the verbal delivery time (due to machine fault at the establishment) making it late for the necessary review for which it was intended. The establishment refuses any discount for late delivery.

A contract doesn't have to be in writing. Verbal contracts are enforceable. They're just harder to prove (often the guilty party, the one who breaches the contract, will lie about it).

Send this customer a demand letter, and then sue him for breach of contract.
