Legal Question in Civil Litigation in Texas

Unlawful Arrest /charges filed

I have a 13 year old son that has been accused of a class A misdemeanor. If the charges are dropped or if he's found not guilty by a jury trial, what are my chances in civil court of:

1. Recouping my attorney's fees and;

2. Winning a claim for damages since my son has been through a very tortuous time the last few months? He was taken out of school and put in a squad car in front of classmates and has been questioned incessantly about the incident by teachers and classmates.

If you have a civil case on which you can prevail depending upon the facts, your expenses and your son's mental anguish are all damages which may be recouped - if you can win the lawsuit.
