Legal Question in Civil Litigation in Texas

valid contracts

About 7.5 years ago, 10/1999, my husband sent a signed letter, without my knowledge, to his daughter, my step-daughter, promising to deposit $500/month into a savings account for his daughters college. My husband did this for awhile, accumulating about $12,000. But because my husband worked contract, some of the money had to be used between contracts to pay living expenses. We used the $12,000 for a down payment on a house.

Now his daughter is 18 and will start college in Sept, 2007. She is demanding her money and threatens to take my husband to court if he doesnt give her the money.

My question, is a promise letter an enforceable contract in Texas his daughter resides in Texas and at the time, we did also.

Thank you.

Re: valid contracts

There's insufficient information to see if a valid contract was formed. It could be enforceable. It would be worthwhile to hire a lawyer to look into it.
