Legal Question in Insurance Law in Texas

on 9/6/11 my girlfriend was stop at a red light a car rearended her, cititation was issued for failure to control a vechical to the other person she attempted to lie several times to the officers about what happen. Any she has insurance, but our dedutable is less than the damage, 450 something . The other lady has state farm and she is not giving a statement or answer her phone for state farm. My insurance is saying the claim is closed on our end because its below the dec. Anyway my insurance is saying that if state farm does not get a statement then state farm can deny the claim and I am stuck paying for it even though both parties have insurance. What are my opions if state farm does not pay for the claim?

if you have uninsured motorist protection, your insurance should pay deductible..State Farm may pay if u sue their insured in JP court..pay for you damages and court cost, no pay for lost time etc...
