Employer reduces insurance benefits without notification

I work for a small city (General Law - Type B) in Texas. I have had insurance coverage through TML since being employed (10/04). In August 2005 the city administrator decided we needed different coverage and asked for bids from several insurance companies. The council asked for equal to or better than coverage. A local agency offering BCBS was awarded the bid. The administrator signed a document in December 2005 that declined maternity coverage (though we had full maternity coverage with our other provider). I am the only employee that this effected. In February 2005 I had stopped taking birth control and started trying to conceive - as I knew I had FULL MATERNITY BENEFITS. In Janaury 2006 our new insurance became effective. I was never provided any information concerning our new coverage. I went to the doctor in April 2006 and found out I was pregnant. It was not until I went to the doctor and had routine tests that I found out I had no coverage. I was provided my plan information only after I requested it from BCBS. Now I am due in October and have NO coverage. Though I feel this is my employer's responsibility, I reported the agent to the TDI since he also promised us dental and vision and we do not have this coverage either.

I don't think you have an individual claim, but the city might have a breach of contract claim against the agent
