Legal Question in Employment Law in Texas

I am employed in the State of Texas. I have been with the company for 10 years and they were taken over by a new Reit company and pulled into an exsiting company that they already had since our company was 4.5 mill in debt. The new company located in the state of Kentucky came in and said we will give you a stay bonus of two months if you stay and help us to get things transferred over through 12/31/11.

My time will end 12/31/11 and then I will get my stay bonus (Thats what they are calling it) it was

also stated that if we are asked to leave early we will still get our pay through 12/31/11 plus the stay bonus of two months.

We are now finding out that they are saying we will pay out our stay bonus but are still paying out the regular salary paid out every two weeks until 12/31/11 making us eneligable for umemployment benefits.

Is this legal?
