Legal Question in Employment Law in Texas

My husband filled out a job application. On the application he disclosed that he had gotten a DWI in 2001. He was called in for an interview. At the interview he filled out more paperwork and again wrote that he had gotten a DWI in 2001. After the interview he was called back for testing. After testing yesterday he was offered the job and he accepted. They called him today and told him they could not give him the job because HR has a policy that the company cannot hire someone if they have had a DWI in less than 10 years. Is there anything we can do?

possible but it would be expensive..was the offer for a specific job at a specific salary per month or per year? if just an hourly job, it is not probable.
