Legal Question in Employment Law in Texas

My company posted Management positions for my area on job boards. I am qualified and applied. My area mgr spoke to me and first said the company is not hiring. I mentioned the posting and re posting of the ads. He then said he is interviewing on the outside because he has to have a balance between inside and outside hires. Is it legal to tell me this? Is it legal to not give me a fair opportunity for an interview and is it possible to get one now without being given a fair shot? Is that legal?

Unless you claim discrimination for sex, age, etc..of course its permissible(legal) for an employer to do what it wants..
