Legal Question in Employment Law in Texas

Wrongful Termination

Can an employee be fired for misconduct while doing all management positions in a eating establishment. I was the only manager after the owner fired key personell, throwing all duties in my lap, then firing me for incomplete work. I could not keep up with the daily workload, due to having no upper management. No office manager, no bar manager, no floor manager and running the kitchen. My position was the Executive Chef /G.M.. I never had a job description, I was never written up for mis conduct. The owner did not train us on certain requirements, yet hold me lible for incomplete tasks.

Re: Wrongful Termination

Unless you had an employment contract, you were in all likelihood an employee at will and could be terminated for any reason whatsoever, or no reason at all, unless you can prove that it was because you fell into a class protected at law from discrimination based on that status. Unfortunately, there is no protection from incompetent management.
