Legal Question in Landlord & Tenant Law in Texas

Want sometime

My home lease is over in Dec.2006. I want to stay in this house for another 6 months as my husband will be out from prison in july,2007. but my landlord wants me to vacant this house soon. Is there any way I can stay here for another 6 months? I have small kids with me and there is no source of income as right now some friends are helping us.

If your lease contract expires and the landlord does not want to renew it, you can't force him to. If you stay without an agreement become what is termed a holdover tenant and your tenant could seek to collect high rents from you and you could be evicted.

Since your lease is up, you are now on a month to month lease. That means either party can give thirty days notice to vacate the lease. If the landlord wants you out, he can make you get out.
