Legal Question in Landlord & Tenant Law in Texas

tenant conflicts and damage

Unfortunately I have to state the fact that I am white and my upstairs neighbor is black. I am moving out of my apartment due to the fact that I cannot sleep at night due to the noise upstairs. I live alone in a one bedroom with my little dog. I work 6-7 days a week. My upstairs neighbor works nights. Her live in boyfriend and her 13 year old son stay in the apartment. There are 3-4 adults living in the one bedroom above me. Constant noise, trash thrown down off balconys, the smell of pot reeking out the door and from the cars they sit in out in the parking lot. Wednesday morning she apparently ran her toilet and bathtub over. She claims she was asleep. She left her apartment without doing anything to stop the water and she didn't report it. The lawn men noticed water coming from my apartment at approximately 3:15pm. Management told me to get home. I was faced with 2 inches of water standing in my apartment. My dog was soak and wetand trembling. Everything on my floor, under cabinets, or up high has water damage. I am trashing and washing as fast as I can. I don't have renters insurance. Do I have to absorb the loss and cost alone?

"Unfortunately I have to state the fact that I am white and my upstairs neighbor is black."

I actually read past this first sentence, waiting to find out why you had to state that fact. Never found the reason, and personally hope no other attorney on this website answers your question.
