Legal Question in Medical Malpractice in Texas

Left surgical equipment inside of body

I wanted to know if it was possible to sue a Doctor after he left two surgical sponges inside of my body. I had several witness to me regurertating the sponges up. I obtained my medical records and the doctor doesn't even mention the fact that while vomitting up blood, also I vommited up the sponges. The surgeon had mentioned to my mom and sister that the reason I was in surgery so long was that the sponge count was off. I was told by my pulmanologist that I also possibly have some vocal cord damage. The surgeon will no longer see patients as of May 1st. I had my surgery on Dec 5th and was hospitalized until Dec 29th 2001. I wasn't able to return to work until March 13th 2002.
