In Texas, by state law, an autopsy is required in any death by other than "natural causes." However, an autopsy is not a prerequisite to filing a medical malpractice lawsuit. Of course, the findings in the autopsy report may in many instances support the claim that there was negligence on the part of the treating physician, so an autopsy is often requested by the family when negligence is suspected.
