Re: accident

Based on what you have written, it appears that you may be able to recover money for your injuries. There are two main issues associated with any personal injury case. First, is liability (e.g., who was at fault). Second, is damages (e.g., what amount of compensation will correct the injury). You should really meet with a local personal injury law firm to discuss your specific case. If my local personal injury law firm can assist you with this legal issue or any other legal matter, please contact my paralegal Tina ([email protected]) to arrange for an initial consultation.

Re: accident

Absolutely. But it's not automatic. Her insurance company will do everything they can do to get out of paying (as all insurance companies do). You need an experienced personal injury lawyer. Call me now. There is no charge for consultation and all cases are taken on a contingency fee basis.

In the meantime, do NOT give a statement to the insurance company. You have nothing to gain and everything to lose by doing so.

I look forward to helping you recover the damages to which you are entitled.

Re: accident

Before the insurance company will pay any money, you will have to prove two things. First, you must show that the accident was her fault. From what you stated above, that should be fairly easy to do.

Second, you will have to show that you suffered some damage. Even if the accident was completely her fault, the insurance will not want to offer you money if you were unharmed.

There are many different categories of damages that you may be entitled to recover. You should consult with a personal injury attorney before you speak to her or her insurance company.

Re: accident

Possibly. In order to recover, you would have to have suffered damages. This could be damage to your bike or personal injuries suffered as a result of the accident. If you didn't suffer any damages, then the insurance company will not pay. If you did suffer damages, you need to file a claim. You should contact a lawyer for this. Most personal injury lawyers will speak with you about your case for free. Talk to a few lawyers, see who you're comfortable with, and press on.

Re: accident

Certainly. The critical issues are not whether you can prove liability, but whether the person that hit you has insurance or if you have UM / UIM coverage if they do not.

You should contact an attorney to discuss your legal options.
