I was in a car accident 10-14-99, have been negoitiating with the insurance co. for a settlement, but I am nearing the anniversary date of the accident. The fact that I am negoiating the settlement, does this protect me from the stauate of limitations for filing a suit?

NO. Only death of a party or filing suit will prevent you from being subject to the statute of limitations. In personal injury cases, that statute of limitations is 2 years. If no settlement has been reached, you had better file and then continue negotiations.

No, the statute of limitations is not tolled by reason of the fact that you are in negotiations. My advise is that you contact an attorney asap. If suit is not filed or the case settled within two years from the date of your accident, you will be forever barred from seeking compensation for your injuries.
