Legal Question in Personal Injury in Texas

My daughter was diagnosed with HSV1 after a child from her daycare reopened one of his cold sores. The teacher who watches her asked the director of the daycare to remove the child but the director didn't. She went to two doctor appointments, urgent care and ended up in the ER for dehydration. Legally, do I have the right to ask daycare to pay for her medical bills since she got it at daycare?
