Legal Question in Personal Injury in Texas

fired due to job injury

My husband was fired from job after hurting his back in April 2004. He filed workers comp and was kicked off because workers comp doctor said it was just a strain. He has since had 4 surgerys to fix injured disc. Employer said he was fired becaused he reached maximum medical improvement July 2004. All 4 surgerys were after this date and he has not been released from doctor since April 2004. What are his rights?

Re: fired due to job injury

You need to contact an attorney regarding two issues:

1. Termination for filing a workers' comp claim

2. A workers comp attorney who can review your husband's WC claim and pursue through the Commission.

YOu may find one attorney who will take both issues, I recommend you contact your local Bar Association for a lawyer referral to a workers' comp attorney. You have a lot of issues here, more than can be covered in an email. Good Luck.
