Legal Question in Personal Injury in Texas

On my way home from work last week, I encountered someone driving on the wrong side of the road TOWARDS me. When I swerved to avoid an accident, my car jumped the curb and I ran right into a tree. The wrong-way driver sped off, discarding empty beer cans out of the window in the meantime. When the police arrived, I was cited, and am now being sued by the state of TX, for destruction of government property...FOR THE TREE. Can I really be sued for this? Isn't there anything I can do?
