Legal Question in Personal Injury in Texas

My husband is a mechanic and had his finger crushed on the job 4 days ago. We have been through extensive ER/doctor visits and he is now going to have his finger amputated. His employer does not carry workers comp and insurance won't help with the medical bills because it was an "on-the-job" injury? He will be out of work for 6weeks with no pay? What are our options?

Basically, if the accident was caused by the negligence of the employer or a co-employee, your husband can make a claim against his employer for his damages (although this type of "claim" almost always requires the filing of a lawsuit, for which you need an experienced personal injury lawyer). However, if the accident happened due to your husband's own inattention or carelessness, and there was no negligence on the part of his employer, a co-employee, or another company (say, for failing to install a guard on a machine, for instance), then it is likely your husband does not have a valid claim. The only way to know for sure is to contact a personal injury attorney and have him evaluate all the angles for you. I would be happy to speak to your husband at no initial charge.
