Legal Question in Personal Injury in Texas

Is it legal to run over children in public in the state of Texas?

Our son was run over, while standing in a public area, by a vehicle that left the road. the driver was an under aged, and the so called monitoring adult was asleep in the front seat. He admits he gave the wheel to the child with the full intent of falling asleep. He also instructed the child to run to a carrivanning vehicle to try to hide the childs identity. the S. A. Police dept. claims no infraction of the law was committed. My son and I were standing in the grass when we were struck. He died immediately. I lost my leg as well. What are my options?
