Legal Question in Personal Injury in Texas

personal injury question

2 months ago i was a pasanger involved in an auto accident with a car that was left on the highway(not pulled to the side of the road and no hasard lights on) how do i go about suing this person and what laws did he/she break? now my boyfriend was killed and my three year old son was injured. I spent a month and a half in the hospital and three days in a comma. My arm was serverly broken to were i have metal rods inside and constant pain everyday.

You need to find out who owns the car. You can determine this by looking up the license plate number, and reviewing the accident report from the police station. There are several different ways to recover, but they tend to be fact specific. For example, the car you were in may have a policy, as well as the policy covering the other car in the accident. I am so sorry to hear about your terrible accident, the death of your boyfriend and the injuries you and your son received. There are several factors to consider in answering your question. If your boyfriend was in any way at fault (either completely or partially), you and your son may be able to file a claim under his liability policy. If the owner or driver of the abandoned vehicle was negligent (by leaving it too close to the roadway with no flashers on), you could also file a claim against his/her liability policy. (If both your boyfriend and the other driver/owner contributed to the accident, you would have a claim against both.) There is also the possibility of an uninsured motorist claim filed on your boyfriend's policy and/or on your own policy, if you have one. After the liability policy limits are exhausted, an underinsured motorist claim might be filed on your boyfriend's policy, your policy, or both.
