My husband was injured at work. His arm was crushed between a car and an alignment lift that lacked the proper safety equipment. Does he have a case for neglegence since the company neglected to use proper safety devices?

Possibly if the employer does not have workers comp insurance, or the employer was grossly negligent. He may also have a case against the manufacturer of the equipment. You should contact an attorney IMMEDIATELY.

Yes, he may have a case against the manufacturer of the alignment lift for failing to have the right equipment or failing to warn of dangers. In Texas, manufacturers have a duty to warn users of their products of dangers and risks.

He may also have a case against his employer if his employer does not have worker's compensation. Even if his employer has worker's compensation, he should contact an attorney to handle it so his rights are protected.

Most importantly, he should not sign any documents without having an attorney review them because he may sign away his right to sue.
