Legal Question in Real Estate Law in Texas

Filing for Affidavit of Heirship

My father in law died 7 years ago at the age of 44 with

no will. He has three sons, my husband being the

oldest. Recently we found out that their were certain

items that went to Unclaimed Property for the state of

Texas. We requested claim forms to retrieve the

items(stock checks, bank account balance ) Upon

review of the claim form, it asks that we send proof that

the property would belong to my husband. It asks for

proof of heirship or executor of estate ( there was no

real estate) How can we obtain this on our own,

without hiring a lawyer, as the amount of the claims is

less money than it would cost us to hire a lawyer to

retrieve them. Thank you

Check out the website http://www.reasonable-doubt.com and 1. Look over the Probate subpage for general information. Then go to the Links subpage, follow the law librarian's home page to the Texas Statutes, search the probate code for an affidavit of heirship. That will probably be what you need.
