Legal Question in Real Estate Law in Texas

My mother recently died and left behind a house. There are five remaining children and two deceased children. One of the remaining children wants nothing to do with the house. One of the remaining children, who stayed there before my mother died, wants to remain there. This is fine; however, we want this house to remain family property. What steps should we take?

To avoid future problems when the family wants to sell, you would be wise to probate the estate now, if all agree, appoint a Trustee..preferably ONE who can make decisions. If you wait, people die and descendant children disagree causing family disharmony...which frequently IS the result of keeping property in the family....Probate now is relatively inexpensive..after arguments expensive
