Legal Question in Real Estate Law in Texas

How do I sell the house we both own?

I have been legally seperated from my spouse for six years. I was awarded the house. My spouse was ordered to vacate. My spouse left and doesn't make any contact with me. How do I proceed to sell?

Hopefully your divorce decree has the correct language to provide you clear title. Your divorce attorney should have obtained a deed from your spouse, but if not and the decree doesn't give you clear title, you have 2 options. Find your spouse and get a deed or go to court and quiet title into yourself. A title company can tell you if your decree is sufficient and if title is insurable.

Ms. Smith is correct. It won't take the title company long to know if you have clear title.
