tenants guest injured on property

I have a rental house with a front wooden deck,the steps do not have a handrail,my tenants mom said she fell and broke her arm and ankle and wants to suit me,there are only 4 steps,the lease says i am not responsible for the tenants or tenants personal injury,can she still suit me and win? i am in texas,thanks mike

Although I would have to read the lease to be sure, but my suspicion is that they could in fact sue you, as the property owner. Now may be a good time to check over the insurance policy on the house to see what sort of notification is required under the policy. You should also see about hiring counsel soon, in case you are sued.
