Legal Question in Sexual Harassment in Texas

Employee dating and consequences

As of currently I am dating a manager at the restraunt i work at. She was not a manager when we started dating and got serious she has only become a full time manager in the past 2 weeks. We are a gay couple. Are general manager told her that he knew about us and that one of 3 things could happen a. she could quit b. i could quit or c. we could break up. Now we have been unable to find in our corporate policy where it states that employees and managers could not date and there is again also the factor that we were together before she was a manager. Also since i our GM has found out about us I have been singled out as to having not been as cheerful our outgoing as my GM would like. Now i work in a very unusual restraunt enviroment were the standard is sarcasm. Now as a girl I guess I am supposed to be cheerful and the men arent required to be as by my GM's standards. But he did say that unless i became more cheerful that if he had to talk to me again that he was going to fire me. This was also the day that he told my girlfriend what our options were for employment there. Also we had heard that he was homophobic.

Sarcasm in wait staff rings true.

I don't think you have a quid pro quo or hostile work environment claim. If you feel that your performance is graded at a different and more critical standard than male employees, then follow the employer's policy for reporting sex discrimination.

If the GM terminates either one of you because of the personal relationship, you may have a sex discrmination claim if heterosexual employees are not terminated for having similar relationship.
