Contents of Bank Safty Deposit Box

How do you obtain access to a Bank Safty Deposit Box after the death of the owner? Parents have passed away and failed to include offsprings as parties with rights to access of box. Deceased Will is believed to be located in lock box.

Go to the bank and explain the situation. A bank officer and a witness should then open the box and take inventory. If a will is found, they will send it to the probate court for filing.

If the bank refuses to open the box, go to the clerk of the probate court and explain the situation. She should have a form you can fill out to order the bank to open the box.

If the bank refuses to play ball, you can petition the probate court in the county in which you live for access. Additionally, if you know who the deceased used for legal services, you may wish to call that firm and see if they have the will. Many times attorneys will keep the original wills for their clients.
