Legal Question in Wills and Trusts in Texas

Contest Will

My father passed away recently and he had my sister and I as beneficiarys to his will,he had told us a month before he passed away if his will was changed to look into it,two weeks before he passed away he met with my sister and told her he changed his will and took me off of it,my stepmother is the executor of the will and my sister and I don't get along with her and my sister is splitting her inheritance with me.Should I or could I contest the will ? I know I'll need an attorney but I'm currently out of work with no income, also how long can she hold up my sisters portion of the will? I hope you will answer these questions.Thank you for your time to review the questions. Jim Cranford

Re: Contest Will

1. You don't have any grounds to contest the will, based upon what you've told me.

2. Your sister would have to force the issue. If your father's will has been probated, and letters testamentary issued to your stepmother, she can legitimately sit on the estate for at least six months after the date letters were issued. Past that, your sister could move the court to have the executrix of the estate provide an inventory and make distribution.
