What do I need to make aclaim to deceased Dad,s( 1952) & step Moms Property There were Two Children by Dad & first wife,stepmom had no children. He had no will, but first wife went to probate for children ,resulting in douccment stating that children would receive Dad,s part,but second wife had a right to live there as long as she wished,which she did until her death in 2001. There were two children,one now deaceased, but leaving one daughter. We have no idear were she is,nor seen her in ten years. I had heard that I would need an heirship affivadit, if so where can I get it & can I do this with out a lawyer. I have no idea how to start. I am on a fixed income, and need advice.

You really need a lawyer to help unscramble all the claims and to handle the necessary court work.

You can do it without a lawyer, if you put in the time at the county law library reading up on the Probate Code, and spending time with the clerks who handle probate matters.
