Legal Question in Wills and Trusts in Texas

probate by muniment of Title

Must an estate be under $50,000 to put through probate by Muniment of Title ?? My house is $126000 which is willed to me, with no debts of the deceased. I live in the home. The will doesn't state an executor. I'm appointed as trustee of the will. Isn't that the same as executor? She meant executor. She bequeth and gave me full house in the will.

You need to do something that will transfer title. Whether it is an affidavit of heirship, probate, or muniment proceedings. Talk to an attorney to see what is best for your situation.

No, the dollar amount is not relevant. I'd need to review your paperwork to see what options are available.

See a local lawyer or let us review your case but you need to probate either as muniment or otherwise..but if the will is valid(no lawyer prepared it as 'trustee")...it should be acceptable as muniment..
