Legal Question in Workers Comp in Texas

Workers Compensation Commission is Corrupt

Been disputing a MMI since april of 2000. At a CCH last year, hearing officer told lies in his report, a transcript and audio was kept! He said: 1.that I said I was to busy moving to dispute the DD ahead of appt. BUT I said I had lost my home due to back dated MMI date & all income was cut, (could not work)! During mail fwd., the ten days allowed to do dispute, passed. 2. I waited a year to do dispute, proof is in commission DRIS notes. He said this 3 times in his report. 3. Even though the hearing officer had documents (listed in transcript) showing the DD has JUST updated my credit reports 3 months before being my DD, he said he did not have a disqualifying assoc. The DD had treated me for same exact areas as present, but now into spinal cord, etc.

I made packets for proof, and submitted all through legislature and comm. (@ 30 packets). The State rep talked to her attorneys, for what I could do since rules were relayed to me incorrectly, missed deadline by 2 days, so dismissed @ district level. She found I could take the hearing officer to court, NOT issue of DD, or commission, But officer himself. BUT how/what do I file? Do I Petition?what grounds do I put for filing, what recourse/damages can I expect?

Re: Workers Compensation Commission is Corrupt

From what you've told me, there's nothing I can

do to help you. An attorney can only be paid from your benefits. You said that you were at MMI in April 2000, but didn't state what your Impairment Rating was. If it is under 15%, you're finished as soon as your benefits are paid our for your IR.

You also told me that you've gone through the entire process and missed the appeal deadlines. Now the statute of limitations has passed for filing in district court. Once the statute of limitations has passed, there's nothing you can do. You waited too long. You should have contacted an attorney a long time ago. From the information you sent, I was unable to determine if you have any claim against the hearing officer.
