Legal Question in Consumer Law in United Kingdom

cold caller

Please help..i was called by someone selling mobiles over the phone.I told them i didnt really want it but i was sent the phone anyway.I tryed to send it back within the time given to return but as i was on holiday i couldnt.My mother tried to call them when i was away to get the address so we could send it back but they wouldnt talk to her as she was not the customer.now iam being sent letters and phonecalls from a debt collecting company for the phone bills.I have never used the phone,in fact i still have it in the package that it was sent to me in.They say i have to pay �51 because i didnt send it back in time.Even though i didnt ask for the phone in the first place.Please help me someone.thanks.

You should simply return this phone and then have no further communication with the company. It does not appear that you have entered into any contract for the purchase and providing this is the case you how no liability to make any payment.
