right of appeal.
My new partner has her own house which was awarded to her through a divorce consent order last year.Here she lives with her three children.We are planning to buy a new house together Her ex-husband is now claiming for part of the equity in the house because he has fell upon bad times, been made redundant, and has now been registered as unable to work again. Does he have the right to appeal and to have the previous decision made in court overturned.

I am pleased to be able to advise you that there is no cause to fear that the consent order transferring your partners house to her will be set aside. In the absence of fraud or deception there is no appeal from a consent order and the purpose of such an order in matrimonial proceedings is to provide certainty in order that the parties may get on with their lives. In any event the change of circumstances which has occurred here is not a ground to set aside an order of the court.
