Legal Question in Immigration Law in USSR (former)

Immigration step daughter to USA

My wife has a daughter in the Ukraine (the daughter is 16 years old) and we just found out that my wifes ex-husband has died. What is the quickest way we can get the minor girl to the USA? We are going to Ukraine in a month to help my step-daughter with temporarily living arrangements. Is there any way we can bring her back immediately? Hardship Visa?

You may be eligible to apply for your stepdaughter as an immeidate relative and ask that the petition be expedited. Alternatively, she may be eligible for humanitarian parole to enter the US. YOu should contact an attorney who will be able to assist you with the application process.

Dear Inquirer:

Since your step-daughter was under 18 at the time you married her mom, she is considered your "child" under US immigration law. You may petition her directly for an immigrant visa, which usually takes approximately one year. You may be able to seek expeditious handling in this case due to the hardships you have mentioned.
