Legal Question in Criminal Law in Utah

Dogs running at large and attacking

I was cited with a misdemeanor B dog running at large and attacking in SLC, Utah.

In two weeks I have to appear before the court.

My question is: I want to keep this misdemeanor off my record. I've never appeared before the court in my life. I don't know how to approach this case. I am a student and cannot afford a lawyer.

Also, I'd like to know if misdemeanor B for dogs running at large and attacking is considered a crime of moral turpitude.

Re: Dogs running at large and attacking

If I were you I would ask the prosecutor to recomend something called a plea in abeyance, which, the the court agrees, will keep the misdemeanor off your record if you comply with the terms of your probation. If you have no priors, and the victim is agreeable, then you have a good shot at securing this disposition. Call the prosecutor well before hand to discuss this with him/her. You will likely have to pay a hefty fine and likely pay restitution as a condition of your porbation. Make sure you have financial documents proving that you could not afford a big fine and that you could not afford an attorney. This correspondence does not constitute legal advice nor does it establish an attorney client relationship.
