Legal Question in Entertainment Law in Utah

Concert DVD Royalties

I am aware that there is a statutory mechanical rate for songs ($.08) used on an album, tape, or cd that usually gets paid through the Harry Fox Agency. Does that same statutory rate apply if the recording is of a concert in which an artist played the song?
