Child support is based on a statutory formula utilizing the parties' incomes and alimony is based on several factors including your need, his ability to pay, the duration of the marriage, and the marital standard of living. Child support is a calculation based on both of your incomes and the number of children. You may also be entitled to alimony which is determined by the court. You should have an attorney to make sure you get not only the correct child support and alimony, but a fair division of property and your share of any retirement benefits you and your husband have. You may call for a free consultation.
